I’ve moved to North Carolina from another state. I had our Wills drafted there. Can I just have our current documents updated?
No. You should have your estate planning from your former state of residence updated to comply with North Carolina General Statutes. Your Will will be probated in the county in North Carolina where you are a resident at the time of your death. Accordingly, the Estates Division of that county courthouse will be able to follow the instructions in your Will that follow the North Carolina General Statutes. If you maintain property in another state while living in North Carolina, then you should contact an attorney in that jurisdiction who may advise you regarding legal protections that are covered there.
